1 Eligibility and Age Requirements

Users Under 13

Children under 13 may only use our Service with verifiable parental consent or through an authorized school or educational institution. Schools using our Service with students under 13 represent and warrant that they have obtained all necessary parental consents or are acting as the authorized agent under COPPA and applicable data protection laws.

Parental Responsibility

Parents and guardians are responsible for monitoring their children's use of the Service and ensuring compliance with these Terms.

2 Description of Service

iDev.Games is a free platform that provides:

• Hosting and distribution of user-uploaded HTML5 games and other browser-based games
• Social features including user profiles, comments, reviews, and community interactions
• Developer tools including game analytics, embeds, and optional monetization features
• An optional iDev Token redemption program for developers
• Educational resources and documentation

This is a free service provided "as is" without guarantees of availability, performance, or continued operation.

3 Account Registration and Security

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information (email address and username)
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You may not use another user's account without permission, create multiple accounts for abusive purposes, or impersonate any person or entity.

4 Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Content

• Upload games or content containing adult content, pornography, or sexually explicit material
• Upload games or content that is hateful, discriminatory, harassing, threatening, or defamatory
• Upload games or content that promotes violence, terrorism, or illegal activities
• Upload games or content containing advertising (including pop-ups, banners, video ads, or redirect links)
• Upload games or content that infringes on any copyright, trademark, patent, or intellectual property rights
• Upload malware, viruses, or any malicious code
• Upload content that violates any applicable law or regulation

Prohibited Conduct

• Harass, abuse, threaten, or intimidate other users
• Spam, flood, or post repetitive content
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use automated bots, scripts, or scrapers without permission
• Interfere with or disrupt the Service or servers
• Manipulate statistics, votes, or engagement metrics
• Impersonate iDev.Games staff or administrators

Violation of this Acceptable Use Policy may result in immediate account termination without notice.

5 Modifications to Terms of Service

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Effective Date" at the top of these Terms and, where appropriate, by posting a notice on the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason including but not limited to:

• Technical or operational issues

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that defects will be corrected or that the Service is free of viruses or harmful components

This is a free platform operated by an individual developer. While we strive for the highest reliability and quality of service, we cannot guarantee:

• Continuous availability or uptime
• That your content will be permanently preserved
• That the Service will meet your specific requirements
• That any errors or defects will be fixed
• That the Service will continue to operate indefinitely

Your use of the Service is entirely at your own risk. You are responsible for maintaining backups of any content you upload.

13 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IDEV.GAMES, ITS OPERATOR, OR ANY AFFILIATED PARTIES BE LIABLE FOR ANY DAMAGES WHATSOEVER.

This includes but is not limited to:

• Direct damages: Loss of data, loss of profits, loss of revenue, or business interruption
• Indirect damages: Consequential, incidental, special, punitive, or exemplary damages
• Personal injury or property damage resulting from your use of the Service
• Unauthorized access to your account or data
• Service interruptions or cessation of the Service
• Errors, bugs, viruses, or malicious code transmitted through the Service
• User-generated content: Any content uploaded by users, including games that may contain malicious code, inappropriate content, or data collection practices
• Third-party services: Actions or omissions of PayPal, Cloudflare, YouTube, or other third parties
• Cryptocurrency: Loss of tokens, wallet access, or cryptocurrency value fluctuations
• Content loss: Deletion, corruption, or loss of uploaded games, posts, or other content

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Important Notes for Users:

• This is a free service with no revenue or commercial insurance
• The Service is operated by an individual developer, not a corporation
• There are no guarantees of continued operation or support
• You use this Service entirely at your own risk

Jurisdiction-Specific Rights: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Maximum Liability: In jurisdictions where liability cannot be excluded, our total liability to you for all claims arising from or related to the Service shall not exceed £10 (ten British pounds) or the equivalent in your local currency.

The Service is operated from the United Kingdom. We make no representation that the Service is appropriate or available for use in other locations. Users accessing the Service from other jurisdictions do so at their own initiative and are responsible for compliance with local laws.

14 Indemnification

You agree to defend, indemnify, and hold harmless iDev.Games, its operator, and any affiliated parties from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including intellectual property, privacy, or publicity rights
• Any content you upload, including games, images, posts, or comments
• Any claim that your content caused damage to a third party
• Your violation of any applicable laws or regulations
• Any claims by other users related to your conduct on the Service

This indemnification obligation will survive termination of your account and your use of the Service.

For Game Developers: You specifically agree to indemnify us against any claims arising from games you upload, including claims related to copyright infringement, inappropriate content, data collection practices within your games, or any harm caused by your games to users or third parties.

9 Game Embeds and Distribution

We provide embed codes that allow games to be played on third-party websites. When using our embed feature:

• You must use the embed code provided by iDev.Games without modification
• You may not manipulate, alter, or bypass the embed code without permission
• We reserve the right to revoke embed access at any time
• Embedded games will display our branding and privacy notices
• Game developers remain responsible for content within their embedded games

Website owners embedding our games are responsible for ensuring the embedded content is appropriate for their audience and complies with applicable laws.

10 iDev Token Redemption Program (Optional)

Our optional iDev Token redemption program allows eligible developers to receive cryptocurrency tokens (Terra Classic LUNC) based on their game performance. Participation is completely voluntary.

Eligibility and Participation

• You must be at least 18 years old to participate in token redemption
• Users aged 13-17 may only participate with explicit parental or guardian consent
• Token redemption is not recommended for children under 13
• You must provide a valid Terra Classic wallet address to receive tokens

Important Disclaimers

• No guarantees: Token redemption is provided "as is" without guarantees of value, availability, or continued operation
• Cryptocurrency risks: Cryptocurrency values fluctuate and may lose value. You accept all risks associated with receiving and holding cryptocurrency
• Tax responsibility: You are solely responsible for any tax obligations related to tokens received
• Wallet security: Wallet addresses are public blockchain data. We are not responsible for wallet security or lost tokens
• No financial advice: Nothing in this program constitutes financial, investment, or tax advice

We reserve the right to modify, suspend, or terminate the token redemption program at any time.

11 Third-Party Services and User Content

Our Service integrates with and displays content from third parties, including:

• User-uploaded games (which may contain third-party code, analytics, or cookies)
• YouTube videos embedded on game profiles
• PayPal for payment processing
• Cloudflare for security and performance
• Links to external websites

We are not responsible for:

• The accuracy, safety, or legality of user-uploaded games
• Data collection practices within individual games
• The content, privacy practices, or availability of third-party services
• Any interactions or transactions with third parties

Your use of third-party services is at your own risk and subject to those third parties' terms and privacy policies.

7 User-Generated Content and Uploads

You are solely responsible for all content you upload, post, or otherwise make available on the Service. This includes games, images, text, comments, reviews, and any other materials.

Your Warranties and Representations

By uploading content to the Service, you represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to upload and distribute the content
• Your content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property rights
• Your content does not violate any laws or regulations
• Your content complies with our Acceptable Use Policy (Section 4)
• You have obtained all necessary rights to use any third-party assets (music, graphics, code libraries, etc.) in your games

License Grant to iDev.Games

By uploading content, you grant iDev.Games a worldwide, non-exclusive, royalty-free, sublicensable license to:

• Host, store, reproduce, and display your content on the Service
• Distribute your content through embeds and sharing features
• Create backup copies for operational purposes
• Include your content in search results, feeds, and promotional materials for the Service

You retain all ownership rights to your content. You may delete your content at any time, which will terminate this license (except for content already distributed through embeds or cached copies).

Developer Responsibility for Games

Game developers are solely responsible for:

• The content, functionality, and safety of their games
• Any data collection, cookies, or tracking within their games
• Ensuring their games comply with applicable laws and age ratings
• Providing appropriate content warnings or privacy notices for their games
• Responding to user complaints or issues with their games

Content Moderation

We reserve the right (but have no obligation) to:

• Review, monitor, or moderate user-generated content
• Remove or disable access to any content that violates these Terms
• Remove content at our discretion for any reason or no reason
• Terminate accounts that repeatedly violate these Terms

We do not endorse any user-generated content and expressly disclaim all liability in connection with user uploads.

Copyright Infringement

We respect intellectual property rights and do not permit copyright-infringing content. If you believe your copyright has been infringed, please contact us at [email protected] with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing content and its location on our Service
• Your contact information
• A statement that you have a good faith belief the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner

We will remove content that properly notified as infringing and may terminate accounts of repeat infringers.

8 Content Storage and Retention

We will make reasonable efforts to preserve your content, but we do not guarantee permanent storage. We may:

• Delete inactive content after extended periods of no access
• Implement storage limits or fair use policies
• Remove content that consumes excessive server resources

You are responsible for maintaining backups of your content. We are not liable for any loss or corruption of content.

15 Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Points:

• We collect only minimal personal information: email address and username
• We do NOT collect IP addresses, real names, or other personal identifiers
• We use only functional cookies necessary for the Service to operate
• Game statistics are linked to your account but are not personally identifiable
• We share your information with third parties only as described in our Privacy Policy (Cloudflare, reCAPTCHA, PayPal, YouTube embeds)

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. Please review our Privacy Policy to understand our data practices.

16 Intellectual Property Rights

iDev.Games Platform Rights

The iDev.Games platform, including its design, code, logos, branding, and original content, is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, reproduce, or create derivative works of the platform code or design
• Use our trademarks, logos, or branding without permission
• Reverse engineer or attempt to extract source code from the platform
• Remove or modify any copyright notices or proprietary markings

User Content Ownership

You retain all ownership rights to content you upload. We do not claim ownership of your games, posts, comments, or other user-generated content.

However, by uploading content, you grant us a license to host, display, and distribute it as described in Section 7 (User-Generated Content).

Developer Rights to Games

Game developers retain all rights to their games and may remove them from the Service at any time by deleting them through their account settings.

17 Account Termination

Termination by You

You may terminate your account at any time by:

• Deleting your account through your account settings
• Contacting us at [email protected] to request account deletion

Upon termination, your access to the Service will be revoked. Your personal information (email and username) will be deleted as described in our Privacy Policy, though some content may be retained as specified in Section 7.

Termination by Us

We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for any reason including but not limited to:

• Violation of these Terms of Service
• Uploading prohibited content (adult content, hateful content, malware, advertising)
• Harassment, abuse, or threatening behavior toward other users
• Copyright infringement or intellectual property violations
• Fraudulent activity or manipulation of platform features
• Extended account inactivity
• Legal or regulatory requirements

We may terminate accounts immediately and without warning for serious violations. In cases of account termination for violations, we may also remove all content associated with your account.

Effect of Termination

Upon termination of your account:

• Your access to the Service will be revoked
• Your games, posts, and other content may be removed from the platform
• You will no longer be able to earn or redeem iDev Tokens
• Sections of these Terms regarding liability, indemnification, and intellectual property will survive termination

18 Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Informal Resolution

Before initiating any formal legal action, we encourage you to contact us at [email protected] to attempt to resolve the dispute informally. Many disputes can be resolved quickly and amicably through communication.

19 General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iDev.Games regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of iDev.Games.

Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign or transfer these Terms or any rights or obligations hereunder without restriction.

No Partnership

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and iDev.Games. You have no authority to bind iDev.Games in any manner.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Survival

The following sections shall survive termination of these Terms and your use of the Service: User-Generated Content (licensing provisions), Disclaimer of Warranties, Limitation of Liability, Indemnification, Intellectual Property Rights, Dispute Resolution, and General Provisions.
